Prayer :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents No.1 to 3 to remove the encroachment made by the 4th respondent in public pathway in S.F. No.397/1, at Nallamaram Village, Peraiyur Taluk, Madurai District, on the basis of the petitioners representation dated 01.08.2022 within time frame fixed by this Honble Court.
ORDER:- This Writ Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. T. Vadivelan, Advocate for the Petitioner and of Mr. S.RA. Ramachandran, Additional Government Pleader for the 1st respondent , and of Mr.G.V. Vairam Santosh Additional Government Pleader 2 & 3 respondent this Court made the following order:
"In the final order passed on 09.09.2022, in paragraph No.4, there was a direction to the first respondent to consider the petitioner's representation and take appropriate action. The representation was for removal of encroachment in Survey No.397/1 at Nallamaram Village. With such directions, the writ petition was directed to be listed for reporting compliance. 2.Today, when the matter was called, the learned Additional Government Pleader submitted that pursuant to the final order of this Court dated 09.09.2022, they had surveyed the land in S.A.No.397/1 and also issued notice under Section 7 2/4
of the Land Encroachment Act. Pursuant to the notice, one of the encroachers had also challenged the said proceedings in W.P.(MD)No.26981 of 2022, which is pending be fore this Court.
3.In view of the actions initiated by the respondents herein, we are of the view that the directions in the final order dated 09.09.2022 has been complied with.
