L.Sarbunnisa v. Xavier Manohar
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 29.08.2024
CORAM
THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN L.Sarbunnisa Represented by the Power of Attorney Agent, S.Ramakrishnan ... Petitioner / Respondent Vs.
Xavier Manohar ... Respondent / Appellant Prayer : Civil Revision Petition filed under Article 227 of the Constitution of India, to expedite disposal of the Appeal in R.C.A.No.7 of 2022 on the file of the Appellate Authority (PSJ) Tiruchirappalli. For Petitioner : Mr.P.Sivachandran
ORDER
Heard the learned counsel for the revision petitioner. Issuance of notice to the respondent is dispensed with.
1/4
2.The petitioner filed R.C.O.P.No.14 of 2018 on the file of the Rent Control Tribunal (II Additional District Munsif Court, Tiruchirappalli) against the respondent and succeeded. Questioning the same, the respondent has filed R.C.A.No.7 of 2022 before the appellate authority. The petitioner wants this Court to direct the appellate authority to dispose of the same expeditiously.
3.Normally, I would be reluctant to issue such a direction because the proceeding is not that old. Secondly, I am not aware of the work load of the Court below.
4.The learned counsel for the petitioner states that the petitioner is a senior citizen aged around 80 years. He also would point out that under the new Act, an appeal has to be disposed of within four months. The case on hand does not arise under the new Act. Be that as it may, in as much as the original proceeding was initiated six years ago and considering the fact that the petitioner is a senior citizen, the learned Principal Sub Judge, Tiruchirappalli (appellate authority) is directed to dispose of R.C.A.No.7 of 2022 on merits and in accordance with law 2/4
within a period of six months from the date of receipt of a copy of this order.
5.The civil revision petition is disposed of accordingly. There shall be no order as to costs.
