Respondent/Plaintiff PRAYER :- This Second Appeal is filed under Section 100 of the Civil Procedure Code, to set aside the judgment and decree dated 19.06.2014 passed in A.S.No.16 of 2011 by the Sub Judge, Kuzhithurai, confirming the judgment and decree passed in O.S.No.339 of 2009, dated 28.10.2010 passed by the Principal District Munsif, Kuzhithurai.

JUDGMENT
When the matter was taken up for hearing today (24.09.2025), the learned counsel for the appellants submitted that the first appellant, namely Mr.Nadesa Panicker, died on 23.06.2019, leaving behind the second appellant as legal heir. Notice sent to the second appellant returned with an endorsement ''Deceased''. Hence, both the appellants are no more and there is no possibility for the appellants' counsel to further proceed with the case. He has also filed a memo to that effect. The said memo is recorded.
2. In view of the above memo filed by the learned counsel for the appellants, this Second Appeal is dismissed as abated. No costs. 24.09.2025 NCC : Yes / No Internet : Yes / No Index : Yes / No VSD 2/4
