O R D E R
(Order of the Court was delivered by DR.G.JAYACHANDRAN,J.) This contempt Petition is filed to condone the delay of 949 days in representing the contempt petition. 2.This contempt petition is filed alleging that the order dated 17.10.2018 passed by the learned Judicial Magistrate No.1, Kulithurai in C.M.P.No.8082 of 2018 to register a complaint and the investigation alleged to have been disobeyed by the respondent, who was functioning as a Inspector of Police at Aranthangi Police Station. 3.For the said reason, the present contempt petition is filed on 29.01.2020. The Registry has found some defects and returned the petition with cheque leaf. After rectifying the said defect, the papers were represented with the delay of 949 days. Hence, the sub application in Sub.Aplc(MD)No.113 of 2022 is filed to condone the delay in representation. Even after four years, the petitioner is unable to serve notice on the respondent in the condone delay petition.
4.This Court, now while perusing the records and the petition filed, finds that the contempt petition presented on 29.01.2020 is beyond the period of one year from the date of order alleged to have been disobeyed. 5.For that reason alone, this petition cannot be entertained and hence, the same stands dismissed. Consequently, the contempt petition also rejected at SR stage.
