PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the 2nd respondent to collect the fine amount imposed on the 5th respondent vide his order in Mu.Mu.A1/5948/2024 dated 22.11.2024 and further directing the Respondent No. 1 to 4 to initiate criminal proceedings against the 5th respondent for conducting illegal mining.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the 2nd respondent to collect the fine amount imposed on the 5th respondent vide his order dated 22.11.2024 and further directing the Respondent No.1 to 4 to initiate criminal proceedings against the 5th respondent for conducting illegal mining.

2. The learned Additional Government Pleader appearing for the respondents submitted that the petitioner and the 5th respondent are sisters. There is a land dispute between them, which has manifested in the form of a sand quarry issue. The respondents have initiated action for illegal mining, and the same will be pursued by them. Therefore, the petitioner cannot seeking a direction to the respondents to act in accordance with the law, as it would amount to interference in their official duties. Hence, the writ petition is not maintainable. 2/4

3. Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs.
