Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to process the petitioner's application dated 09.07.2024 bearing file number MD1076728677324 and to issue a passport to the petitioner within a time frame as may be stipulated by this Court.

ORDER
This writ petition has been filed for a writ of Mandamus to direct the first respondent to process the petitioner's application dated 09.07.2024 bearing file number MD1076728677324 and to issue a passport to the petitioner.
2. It is noticed that an FIR has been registered against the petitioner in Crime No.2293 of 2022 dated 29.11.2022 by the second respondent police for the offences under Sections 147, 148, 294(b), 323 of the IPC and Section 4 of the Tamil Nadu Public Property (Prevention of Damage and Loss)Act, 1992.
3. The learned Government Advocate for the second respondent submits that a charge sheet has been filed before the Judicial Magistrate V, Madurai and the case has been taken on file as P.R.C.No.310 of 2025.
4. Since the case has been registered against the petitioner, the prayer 2/4
for processing the passport's application of the petitioner at this stage cannot be countenanced. However, it is always open to the petitioner to approach the concerned Court by filing a suitable application at the appropriate stage for the first respondent to process the passport application.
5. The writ petition stands disposed of with the above liberty. There shall be no order as to costs.
