JUDGMENT

It is seen that the appeal has been dismissed as against the third respondent on 09.02.2017 itself and no steps have been taken to restore the same.

2. It is also reported that the fourth respondent died on 30.03.2019 and no steps have been taken and hence, this second appeal is abated as against the fourth respondent.

3. The learned Counsel for the appellant reports no instructions and hence, this second appeal is dismissed for nonprosecution. No costs. Consequently, connected miscellaneous petition is closed.
