PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 4 to remove the encroachments in public pathway in Survey No.22/21 situated at Kannakkur Village, Thalanur Post, Avudaiyarkoil Taluk, Pudukkottai District, made by the respondents 5 and 6 on the basis of petitioner's representations dated 06.12.2024 and 17.03.2025.

O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] Mr.M.Sarangan, learned Additional Government Pleader, takes notice for the respondents 1 to 3 and Mr.S.P.Maharajan, learned Special Government Pleader, takes notice for the fourth respondent.

2. In view of the limited nature of the relief sought for by the petitioner, notice to the private respondents is dispensed with.

3. With reference to the relief sought for in this writ petition, learned Additional Government Pleader appearing for the respondents 1 to 3, on instructions, submitted that a survey has been conducted, encroachments have been identified and further actions will be initiated in accordance with law.

4. In view of the above submission, the respondents 3 & 4 are directed to initiate enforcement action for removal of encroachments and conclude the same by following the procedures as contemplated under the relevant statute and rules, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
