PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the records in FIR registered in Cr No.449 of 2016 dated 26.09.2016 pending investigation on the file of the first respondent and quash the same.

O R D E R

This petition has been filed to quash the F.I.R. in Crime No.449 of 2016 dated 26.09.2016 pending investigation on the file of the first respondent.

2.The learned Counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Without any base, the first respondent police registered a case in Crime No.449 of 2016 for the offence under Sections 294(b) and 387 of I.P.C. as against the petitioner. Hence he prayed to quash the same.

3.The learned Government Advocate(Crl.Side) would submit that the investigation has been completed and final report has been filed before the concerned Court and the same is yet to be taken cognizance and hence, the prayer sought for by the petitioner has https://hcservices.ecourts.gov.in/hcservices/ 1/2

4.Recording the submission made by the learned Government Advocate (criminal side), this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
