Respondents PRAYER: Habeas Corpus Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, directing the respondents more particularly the 2nd respondent to secure petitioner's daughter namely Pavithra Devi, D/o.R.Kumar female aged about 21 years residing at 6/66 Middle Street, Koodankulam, Tirunelveli District and subsequently produce her before this Court for setting her at liberty forthwith.

ORDER

(Order of the Court was made by M.S.RAMESH, J.) When the petitioner's daughter, namely, Pavithra Devi, aged about 21 years, had gone missing from 01.08.2023, he had given a complaint on the same day before the second respondent police. Since the petitioner's daughter could not be traced within a reasonable time, he has filed the present Habeas Corpus Petition.

2. Today, when the matter was called, the learned Additional Public Prosecutor submitted that the petitioner's complaint has been registered in Crime No.401/2023 on 01.08.2023 and that the second respondent police are conducting the investigation to locate the petitioner's daughter. He further submitted that the girl, who is aged 21 years, had eloped and married one Muthuselvan, S/o.Gurunathan, aged about 22 years, who is also a resident of the same street as that of the petitioner.

3. Both the girl as well as the boy Muthuselvan are majors and the second respondent had also registered the petitioner's complaint and are in the process of investigating, we deem it fit that the second respondent be directed to expedite the investigation and file a final report.

4. In view of this decision, the prayer sought for in the present Habeas Corpus Petition does not require consideration. Accordingly, there shall be a direction to the second respondent to expedite the investigation in Crime No.401/2023 and file a final report as expeditiously as possible.
