ORDER

The writ petition is filed challenging the order passed by the second respondent rejecting the application of the petitioner dated 23.12.2024, seeking survey of the property purchased by her under a sale deed dated 23.08.1996.

2.The main grievance of the petitioner is that the application submitted by her was rejected without any reasoning, that too, without affording reasonable opportunity to the petitioner. 3.The learned Government Advocate appearing for the respondents, on written instructions from the firs respondent, would submit that the petitioner purchased the subject property, namely, Plot No.8, in an unapproved layout and at the time of survey, the petitioner failed to produce the layout plan. Therefore, the petitioner's

application for survey of the subject property has been rejected. She would further submit that if the petitioner is able to produce the layout plan, her request for survey will be considered in accordance with law. 4.It appears that the decision of respondents has not been communicated to the petitioner. The impugned order, which is a screenshot from the official online portal maintained by the Department of Survey and Settlement, indicates no reason for rejection of the application submitted by the second respondent. Hence, the same is quashed and the first respondent is directed to consider the application of the petitioner in Application No.2024/0123/22/006736, dated 23.12.2024 and pass fresh orders on its own merits and communicate the same to the petitioner within a period of four weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 30.07.2025 NCC : Yes/No Index : Yes/No Internet : Yes/No cp
