O R D E R
The Petitioner herein seeks a direction to the respondents to dispose of the Petitioner's application in Na.Ka.A4/10529/2024, dated 6.12.2024.
2.Mr.M.Gangatharan, learned Government Advocate takes notice for the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the third respondent, notice to him is dispensed with.
3.It is the case of the Petitioner that the property comprised in S.No.192/2A, Anaiseri Village, Mudukulathur Taluk, Ramanathpuram District originally belongs to the Petitioner's mother Kuncharam Ammal. After the death of Kuncharam Ammal, the above said property has been in possession of her children including the Petitioner. However, the name of Thireesangu, the third respondent herein, has been recorded in the revenue records. Therefore the Petitioner submitted the instant application seeking cancellation of patta in the name of 2/5
Thireesangu and for restoration of same in the name of Petitioner's mother Kuncharam Ammal. The same has not been considered till date. Hence the Petitioner has come before his court with the present Writ Petition for the relief stated supra. 4.Mr.M.Gangatharan, learned Government Advocate who takes notice for the respondents 1 and 2 would submit that enquiry has already been initiated by the first respondent and date of enquiry is fixed at 6.8.2025.
5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the application of the Petitioner in Na.Ka.A4/10529/2024, dated 6.12.2024 and pass final orders on its own merits after issuing notice to the Petitioner, third respondent and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
