ORDER

This writ petition is filed seeking mandamus, to direct the second and third respondents to consider the petitioner's representation dated 04.04.2025 to re-fix the pension in the cadre of Tahsildar with all monetary benefits.

2. The claim of the petitioner is that his representation dated 04.04.2025 seeking re-fixation of pension in the cadre of Tahsildar with all monetary benefits, is to be considered by the respondents.

3. It is his case that the petitioner had been acquitted in a criminal case. The suspension order that was passed and the charges framed by the Department has been quashed. Further, relying upon the order of the Hon'ble Division Bench of this Court in W.P.(MD)No.25468 of 2021 dated 12.07.2024, submits that he is entitled to grant with notional promotion on par with his juniors and also be granted monetary benefits from the date of the promotion order passed, on part with his juniors. 2/5

4. Learned Special Government Pleader would submit that the petitioner cannot claim parity as ordered by this Court in the said writ petition. He would further submit that, the claim of the petitioner would be considered within a time frame.

Considering the facts and circumstances of this case, the second respondent is directed to consider the representation of the petitioner dated 04.04.2025 in the light of the order passed by Hon'ble Division Bench of this Court in W.P.(MD)No.25468 of 2021 dated 12.07.2024, in so far as, it is applicable to the case of the petitioner and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
