PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C COMMON PRAYER :- For Anticipatory Bail in Crime Nos. 336, 231, 331 /2023 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 7(1) and 7(3) of Tamil Nadu Lottery Regulation Act, 1988, in Crime No.336 of 2023, for the offences under Sections 353 of IPC and Sections 7(1) and 7(3) of Tamil Nadu Lottery Regulation Act, 1988 in Crime No.231 of 2023 and for the offences under Sections 143 & 353 of IPC and Sections 7(1) and 7(3) of Tamil Nadu Lottery Regulation Act, 1988 in Crime No.331 of 2023, on the file of the respondent police, seeks anticipatory bail by filing these three petitions.
2.The case of the prosecution in Crime No.336 of 2023 is that on 17.07.2023, at about 10.30 hours, on secret information, the defacto complainant along with his officials went to the occurrence spot. On seeing the police party, the accused person tried to escape from that place. He was caught hold by the police party. On interrogation, the accused admitted that he is selling lottery tickets over the phones. 2/5
Hence, the case. Even after registration of the above said Crime number, it was repeated by the accused person. Hence, the subsequent crime numbers have been registered. The cell phones, lottery tickets and two wheeler have been recovered from the accused.
3.When the matter was heard, the learned Government Advocate (Crl. Side) would submit that the petitioner is involved in 7 previous cases. On that ground he was required to produce the CD files in all the matters. 4.The learned counsel for the petitioner would submit that the petitioner is the President of the Merchant Association in that area. Due to that only repeated complaints have been registered against the petitioner by the police. He has also filed undertaking affidavit that he will not commit similar mistakes in future. It has also been stated that in one or two cases, the FIR registered against him were quashed by this Court. Even though some of the FIRs have been quashed, the fact remains that the petitioner in spite of repeated registration of the FIRs, continues the very same activity.

5.Therefore, considering the bad antecedents, this Court is not inclined to grant anticipatory bail to the petitioner in all three cases. 6.Accordingly, all these three criminal original petitions are dismissed. sd/- 14/09/2023 / TRUE COPY / /10/2023 Sub-Assistant Registrar (C.S.)
