Criminal Original Petition filed under section 482 of Criminal Procedure Code, to issue direction to transfer enquiry of the petitioner complaint, dated 29.08.2019 from the third respondent to the second respondent.

O R D E R

This Criminal Original Petition has been filed for transfer of investigation.

2. The learned counsel appearing for the petitioner would submit that the complaint lodged by the petitioner clearly attracts the offence under Section SC/ST Act. Even then the complaint was not enquired by the second respondent and it is pending on the file of the third respondent.

3. Considering the facts and circumstances of the case, the third respondent is directed to enquire the complaint lodged by the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P(MD).No. 13591 of 2019 petitioner in CSR No. 305 of 2019. If there is any offence is made out under SC/ST Act, the entire records shall transfer to the file of the second respondent and on receipt of the same, the second respondent is directed to enquire the matter and conduct the investigation.

4. With the above directions, this Criminal Original Petition is disposed off.
