ORDER:- This Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.R.Jeyapalam, Advocate for the Petitioner and of Mr.M.Sengu Vijay, Advocate, for R4 to 6,8 to 10, 12, 28 &29 and Mr.S.Anwar Sameem, Advocate for the 13th Respondent, this Court made the following order: The above Civil Miscellaneous petition has been filed to set aside the order dated 17.08.2022 made in AS(MD) no.165 of 2022 which was ordered to be dismissed for non-Prosecution and restore the same on file.
2.Heard the learned Counsel appearing for the petitioners. 3.The learned Counsel appearing for the R4 to 6,8 to 10, 12 &13 respondent would submit that they are not having any objection to allow this petition.
4.Considering the above, this Civil Miscellaneous petition is allowed and the Registry is directed to restore the appeal on file.
