ORDER : The Court made the following order :- The petitioner/Accused No.3, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 8 (c), 20(b)(ii) (c), 25 of NDPS Act, in Crime No.132 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner was found in illegal possession of Ganja in three sacks and each sack weighing about 10 Kg. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor strongly opposed this petition on the ground that three accused came in two wheeler. At the time of checking, the petitioner herein, ran away from that place and the respondent police recovered 30 Kg of Ganja in three sacks. A1 & A2 were already arrested and remanded to judicial custody.

5.Considering the seriousness and gravity of the offence alleged, this Court is not inclined to grant anticipatory bail to the petitioner.
