For Respondent : Mr.B.Nambiselvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.38 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/ accused, who apprehend arrest at the hands of the respondent Police for the offence punishable under Sections 5(1) and 6 of POCSO Act, in Crime No.38 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution that the petitioner sexually harassed the defacto complainant and also sent vulgar messages through whatsapp. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent persons and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to comply any stringent condition that may be imposed by the Court.

4. The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner sexually harassed the defacto complainant and also repeatedly sent vulgar messages through whatsapp. However, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the gravity of the offence and also considering the conduct and attitude of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
