This writ Miscellaneous petition filed under 226 of the constitution of India to Setaside the order dated 09.08.2019 made in WP(MD) No.20423 of 2015 and restore the same. Prayer WP(MD). No.20423 of 2015:- This writ petition filed under 226 of the constitution of India to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned order passed by the 3rd respondent 1/3

in his proceedings in Aa.Thi.Mu.No.2773/A6/2015 dated Nil.7.2015 and quash the same as illegal and consequentially to direct the respondents to sanction incentive increment to the petitioner for having acquired M.Sc(Botany)., and M.Phil within the period that may be stipulated by this Honble Court.

ORDER:- This writ Miscellaneous petition coming up for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.C.Venkatesh Kumar For Ajmal Associates , Advocate for the Petitioner and of Mr.N.Shanmugaselvam, Government Advocate for the respondents, this Court made the following order:

This petition has been filed by the petitioner seeking to set aside the dismissal order dated 09.08.2019 and restore W.P(MD). No.20423 of 2015 which was dismissed for non-prosecution. 2.The learned Special Government Pleader is not present today. 3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, the dismissal order dated 09.08.2019 passed in W.P(MD).No.20423 of 2015 is set aside and W.P (MD)No.20423 of 2015 is restored to file.

4.This petition is ordered accordingly.

5.Registry is directed to post the W.P(MD).No.20423 of 2015 for final hearing on 03.03.2020.
