PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to provide adequate police protection to the petitioner, its employees, and workers to enable the lawful execution of solar energy works including laying of HT electric lines. The petitioner is a Private Limited Company, in the name and style of M/s. DVN Energy Solutions P. Ltd., located at Karur. The Company is engaging in establishing and operating solar power generation system. This writ petition is filed, seeking a Mandamus to the respondents to provide adequate police protection 2/7
to the petitioner Company and its employees, enabling them to execute the solar energy project.
2.The learned counsel for the petitioner submits that the petitioner Company has entered into a Memorandum of understanding with the Government of Tamil Nadu to establish 250 megawatt solar Power Plant at Pudukkottai, Dindigul, Tiruchirapalli, Perambalur districtsat a cost of ?1375 crores. According to him, by this project, 180 persons would be directly and indirectly benefited. Moreover, necessary permissions and technical approvals were obtained for erecting High Tension (HT) electric lines, based on which, the Tamil Nadu Generation and Distribution Corporation Limited (TANGEDCO) issued a work order, dated 29.05.2025 and to start related site activities. As per the memorandum of understanding, when they were attempting to lay the solar panels, some individuals have created problem and raised objections, demanding money that this project has been made in the Government poramboke land. The petitioner has furnished all the 3/7
documents and satisfied the officials that he is executing the project only in his Pata land. Even then, the respondent police has not provided police protection and therefore the miscreants are demanding money and preventing this petitioner from executing the project. Therefore, the petitioner is before this Court. 3.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 1 to 5. Mr.F.Deepak, learned Special Government Pleader takes notice for the sixth respondent. The learned Additional Public Prosecutor submits that the persons, who raised objections have been called to the police station and they have been advised that the project has been executed with the memorandum of understanding with the Government, in the petitioner's patta land and therefore they are not supposed to interfere in this matter. In the event, if they continue to disturb the petitioner, they would take appropriate action. 4/7
4.Recording the submissions of the learned Additional Public Prosecutor, this Writ Petition is closed with a direction to the respondent police to provide adequate police protection, if there is any objection, to enable the petitioner to execute the Power Project, as per the work order, dated 29.05.2025.
