Respondent/Respondent/Respondent Prayer :- This Civil Miscellaneous Second Appeal filed under secetion 28 of the Hindu Marriage Act read with section 100 of C.P.C against the judgment and Decree dated 29.02.2016 H.M.C.M.A No.01 of 2010 on the file of the learned District Judge, Sivagangai confirming the judgment and decree dated 18.11.2009 in H.M.O.P.No.110 of 2008 on the file of the Subordinate Judge, Devakottai. ORDER:- This Appeal coming on for orders on this day and upon perusing the earlier order of this dated 11.11.2022,19/12/2022 and 19.01.2023 and upon hearing the arguments of Thiru.V.R.Shanmuganathan, Advocate for the Appellant and of Thiru. H.Lakshmi Shankar,Advocate for the respondent, this Court made the following order:

When the matter was taken up for hearing, the learned counsel for the appellant stated that the entire payment was made as per the condition 3(a) of the compromise memo. The respondent has withdrawn all the cases against the appellant and prayed a suitable order may be passed in this appeal.

2.The learned counsel for the respondent admitted that the respondent received the amount mentioned in column 3(a) of the compromise memo. The respondent has withdrawn all other cases filed against the appellant and the respondent has not objection in allowing the appeal.

3.Since the terms and conditions mentioned in the compromise memo were complied, the Civil Miscellaneous Second Appeal is allowed and the marriage between the appellant and the respondent dated 08.06.2005 is hereby dissolved as per the terms of 3(a) of the https://www.mhc.tn.gov.in/judis 1/2

CMSA(MD). No.39 of 2016 compromise memo. The compromise memo shall form part of this order and decree.
