O R D E R

The petitioner, a practicing Advocate has lodged a complaint before the respondent police that his house has been damaged and CCTV cameras fixed in his house have also been damaged by some miscreants. The complaint of this petitioner was registered in CSR No.45 of 2023, dated 18.03.2023. The grievance of the petitioner is that the respondent police has not proceeded with the investigation in a proper manner and register a case. Therefore, the petitioner has filed this petition to transfer the complaint of this petitioner to some other investigating officer. 2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the respondents submits that they have enquired the complaint of this petitioner in CSR number 45 of 2023, dated 18.03.2023 and closed the same in the year 2023. However, since 2/5

this petitioner has filed a direction petition before this Court, seeking a direction, they have registered a case in Crime No.102 of 2025, for the offence under Sections 49, 329(4), 324(4) and 303(2) of BNS, 2023 as against one Chandran and two others.

3.Considering the manner, in which, the complaint of the year 2023 has been registered with the First Information Report in the year 2025, this Court directs the Superintendent of Police, Madurai, to withdraw the case in Crime No.102 of 2025 from the file of the respondent police and entrust the same to some other investigation officer, to conduct a fair investigation in the above crime number. 4.With the above direction, this Criminal Original Petition is disposed of.
