Respondents PRAYER : This petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to hand over the petitioner's Erdiga ZDI BS IV (Grey Color) car bearing registration number TN 10 AQ 6628, Engine No.D13A5061286 and Chassis No.MA3FLEB1S00253051 to him by invoking section 102(3) of Cr.P.C., within time frame fixed by this Court.

ORDER

This writ petition has been filed seeking direction to the respondents to hand over the petitioner's Erdiga ZDI BS IV (Grey Color) car bearing registration number TN 10 AQ 6628, Engine No.D13A5061286 and Chassis No.MA3FLEB1S00253051 to him by invoking section 102(3) of Cr.P.C., within time frame fixed by this Court.

2. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents would submit that the unidentified vehicle was found and a case has been registered in Crime No.283 of 2019 under Section 102(3) of Cr.P.C. Thereafter, the aforesaid car was handed over to the second respondent on 11.05.2019.

3. Considering the submissions made by the learned Additional Public Prosecutor, the petitioner is directed to approach the second respondent to file an application for returning of his vehicle and on receipt of the same, the second respondent is directed to verify the ownership of the vehicle Erdiga ZDI BS IV (Grey Color) car bearing registration number TN 10 AQ 6628, Engine No.D13A5061286 and https://hcservices.ecourts.gov.in/hcservices/

Chassis No.MA3FLEB1S00253051 and consider the request and pass an order on merits and in accordance with law, within a period of four weeks, from the date of receipt of copy of the order.

4. With the above terms, the writ petition is disposed off. No Costs.
