ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 IPC and Section 21(1) of the Mines and Minerals (Development & Regulations) Act, 1957 in Crime No.185 of 2022, seeks anticipatory bail.
2.The case of the prosecution is that the sand worth about Rs.3,000/- has been illegally taken, upon which the present case has been registered.
3.The earlier application filed by the petitioner was dismissed on the ground that the petitioner is having two previous cases. This is the second application of the petitioner. 4.The learned counsel for the petitioner submitted that enquiry has been completed in this case and final report has been made and the same is going to be filed before the concerned Court. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.16690 of 2022 5.The learned Additional Public Prosecutor Advocate (Crl.Side) appearing for the respondent police submitted the petitioner is having two previous cases of similar nature.
6. The fact that the final report is made ready cannot be a ground for granting anticipatory bail to the petitioner. Taking into consideration the allegations and also the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
