Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st to 4th respondent to forbear the 5th respondent to run public landing place, halting place or car-stand and levy fees for the use of the same in the name and style of Freedom Fighters Martyrs Heirs Association in Old Survey No.303/13, New Survey No.422/3 an extent of 200 sq.mtr near Kamarajar Bus Stand, Thiruvadanai Village, Ramanathapuram District in contravention of the Tamil Nadu Panchayats (Public Landing places, Halting Places, Cart stands) Rules, 1999 issued in G.O.(Ms).No.184, Rural Development (C4) Department dated 30.08.1999 by considering the petitioner's representation, dated 14.07.2025 and for other such reliefs.

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.

2. The petitioner is the successful bidder pursuant to the tender floated by the fourth respondent on 18.06.2025. Accordingly, the contract was awarded to the petitioner for the period from 18.06.2025 to 17.06.2026, for managing the two-wheeler parking facility near Kamaraj Bus Stand, Thiruvadanai Village, Ramanathapuram District.

3. It is the case of the petitioner that the fifth respondent is running a private parking area in contravention of the Tamil Nadu Panchayats (Public Landing places, Halting Places, Cart stands) Rules, 1999 issued in G.O. (Ms).No.184, Rural Development (C4) Department dated 30.08.1999.

4. The concern of the petitioner deserves a proper attention by the fourth respondent in the given circumstances. Accordingly, the fourth respondent is directed to consider the petitioner's representation, dated 14-07-2025 and take appropriate steps to remove illegal parking put up by the fifth respondent. Needless to state, before taking such action, appropriate notice shall be issued to the fifth respondent. The entire exercise shall be completed within a period of four weeks from date of receipt of copy of this order. 3/5

5. With the above direction, this Writ Petition stands disposed of. No costs.
