Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, to call for the records on the file of the first respondent in his proceedings in Na.Ka.No.NA1/35595/2012 dated 04.06.2014 and quash the same as illegal and consequently direct the second respondent to release the vehicle bearing Reg.No.TN 76 U 6880, Maruthi Omni Van and hand over the same to the petitioner, within a time frame fixed by this Court.

O R D E R

This writ petition is filed as against the order passed by the District Revenue Officer, Tirunelveli District, confiscating the petitioner's vehicle, which was involved in Crime No.265 of 2012. 2.The learned counsel appearing for the petitioner submits that the second respondent has registered a case in Crime No.265 of 2012, dated 14.09.2012 as against the petitioner, for the offences punishable under Sections 4(1) (a) and 7 (i) (a) of LPG RSD Order 2000 r/w 7 (i) a(ii) of Essential Commodities Act, 1955 and recovered the petitioner's vehicle bearing Registration No.TN 76 U 6880. The authorities have initiated confiscation proceedings under the Essential Commodities Act, as against which, the petitioner filed this writ petition in the year 2014 and the same is still pending.

3.The learned Additional Government Pleader appearing for the first respondent submits that the petitioner's vehicle has 2/5

already been confiscated and order has also been passed to that effect as early as on 08.12.2015.

4.The learned Government Advocate appearing for the second respondent submits that the petitioner has pleaded guilty in Crime No.265 of 2012 and has also paid a sum of Rs.3,000/- as fine amount.

5.Considering the subsequent development that the petitioner has pleaded guilty, paid the fine amount and the confiscation proceedings has also been completed, this Court is not inclined to pass any further orders in this writ petition. 6.Accordingly, this writ petition is dismissed. No costs. Consequently, connected Miscellaneous Petition are closed. 21.03.2023 NCC : Yes / No.
