Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorari, calling for the records relating to the impugned notice dated 14.11.2014 made in Na.Ka.No.A7-14215-2014 issued by the second respondent and quash the same.

O R D E R

This writ petition is filed as against the impugned notice dated 14.11.2014 issued by the second respondent, calling upon the petitioner to furnish the statement of accounts in pursuance to the license granted by the Tahsildar in Na.Ka.No.7-/7074/10 dated 21.05.2010, in favour of the petitioner for running a Pawn Broker shop.

2.This writ petition is filed in the year 2014 and not even a notice was ordered and at request of the learned counsel appearing for the petitioner, it was adjourned to 24.11.2014. Thereafter, it was listed only on 08.03.2023. On that day also, the petitioner's counsel sought for time and hence, it was once again adjourned to 15.03.2023. Even today (21.03.2023), the learned counsel for the petitioner is not in a position to get instructions from the petitioner and he filed a memo to that effect.

3.From the averments made in the affidavit filed in support of this writ petition, it is seen that the petitioner has obtained a license for doing Pawn Broker business in the year 2010. Pursuant to the criminal case registered in Crime No.270 of 2014, dated 06.11.2014, based on the recommendation of the Inspector of Police, Sivagangai District, dated 06.11.2014 and as per the report of the Deputy Tahsildar, dated 13.11.2014, the Tahsildar, Sivagangai has issued a notice and called upon the petitioner to furnish the details of his accounts along with relevant documents, by appearing in person on 18.11.2014 at 10.00 a.m. By filing this writ petition, the petitioner has not appeared for the enquiry.

4. Though the notice impugned in this writ petition is only an enquiry notice, which has been issued by the Tahsildar concerned, for the purpose of appearance of the petitioner along with the relevant documents, the petitioner has not appeared before the authorities.

5.In view of the above, this writ petition is dismissed. The petitioner shall appear before the concerned authority along with the relevant documents to explain his case. No costs. Consequently, connected Miscellaneous Petitions are closed. 21.03.2023 NCC : Yes / No.
