ORDER

The petitioner is the District Secretary of a political party in Tamil Nadu. He filed the present petition seeking a direction to take action on his complaint dated 22.02.2018.

2.Today, when the matter was taken up for hearing, the learned Additional Public Prosecutor, on instructions, submitted that the said complaint has not been received by the jurisdictional police. 3.This Court has also perused the records produced by the petitioner along with this direction petition and found that there is no material to show that the complaint was received by, or even sent to, the jurisdictional police. As per the provisions of the Cr.P.C., it is the duty of the complainant, in the event of refusal to receive the complaint, to send the complaint to the Superintendent of police. Further, under the provisions of Section 156 of Cr.P.C., in the event of refusal or failure to take action on the complaint, several remedies are available to the petitioner. In view of the above circumstances, this Court is not inclined to entertain this petition.

4.Accordingly, this Criminal Original Petition stands closed, granting liberty to the petitioner to file a complaint before the jurisdictional police, if so advised, and proceed further in accordance with the provisions of the BNSS. 02.03.2026 sbn To 1.The Deputy Superintendent of Police, Karaikudi, Sivagangai District.
