ORDER
The present Writ Petition is filed for Mandamus directing the first respondent to take appropriate action against the second respondent on the basis of the petitioner's resolution dated 10.07.2022.
2. The petitioner would submit that he is the chairman of the Palakari Jeeyar Mutt, which is about 150 years old and the said Mutt was managed by the first respondent from 2012 till 2022. As per the order of the first respondent, the second respondent, who is the 6th Patta Jeeyar, took charge on 08.09.2022. The petitioner alleges that the misconduct of the second respondent has brought disrepute to the management of the Mutt and on 04.01.2023. Resolution was thus stated to have been passed by the General Committee Meeting of the Mutt for taking action against the second respondent. Subsequently, the Advisory Committee has also passed resolution on 10.07.2022 and the same was forwarded to the first respondent. Since no action was taken by the first respondent, the present Writ Petition has been filed. 2/5
3. At the outset, the learned Additional Government Pleader appearing for the first respondent would submit that the petitioner may submit a representation and the same would be considered and orders would be passed in accordance with law.
4. In view thereof, the petitioner is permitted to submit a fresh representation within a period of two (2) weeks from the date of receipt of a copy of this order. If any such representation is made, the first respondent shall consider the same and pass appropriate orders on merits and in accordance with law, after putting the petitioner and other interested parties/stake holders on notice, within a period of eight (8) weeks thereafter. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
5. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed. 23.08.2024 Index : Yes / No 3/5
