Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus to forbear the respondents from constructing a Bus stop shelter in the petitioner's patta land in Survey No.224/2 of Melakulam Village, Mudukulathur Taluk, Ramanathapuram District, by considering the petitioner's representation, dated 25.06.2025 within the period that may be stipulated by this Court.

ORDER
This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner and learned Special Government Pleader for the respondents.
2. This is the second round of litigation at the behest of the petitioner. Earlier, the petitioner had filed W.P.(MD) No.19649 of 2025 with almost an 2/6
identical prayer in respect of the land in Survey No.244/2. The said Writ Petition was dismissed with the following observations: "2. In support of the present Writ Petition, the petitioner has filed a copy of Patta No.1052, as per which, the petitioner appears to be the owner of the land in Survey No.224/2 measuring an extent of 0.41.00 hectares. However, the document, which has been filed by the petitioner in support of the present Writ Petition, does not support the relief sought for in this Writ Petition. Thus, the Writ Petition is liable to be dismissed. However, it is open for the petitioner to work out the remedy in the manner known to law.
3. Accordingly, the Writ Petition stands dismissed with liberty to the petitioner to file a fresh Writ Petition. There shall be no order as to costs."
3. Today, in this case, the petitioner has prayed for a Mandamus to forebear the respondents, particularly, the fourth respondent from putting up a Bus Stop shelter in the land in Survey No.224/2.
4. The learned Special Government Pleader for the fifth respondent submits that pursuant to the survey conducted by the fourth respondent, the proposed Bus Stop shelter is being put up in the land in Survey No.225, measuring an extent of 230 sq.ft. There is no proposal to put up the Bus Stop over the petitioner's patta land in Survey No.224/2 of Melakulam Village, Mudukulathur Taluk, 3/6
5. Since the petitioner has already given a representation, dated 25.06.2025 to the first respondent, the first respondent is directed to transmit a copy of the same to the fifth respondent. The fifth respondent is directed to pass appropriate orders, after giving a copy of the report of the fourth respondent/Tahsildar to the petitioner in respect of the proposed construction. This exercise shall be completed within a period of two (2) weeks from the date of receipt of a copy of this order.
6. This Writ Petition is disposed of, with the above observations. No costs. Consequently, connected miscellaneous petition is closed. Index : Yes / No 25.07.2025 Internet : Yes / No apd To
