For Respondent : Mr.E.Antony Sahaya Prabhakar Additional Public Prosecutor PRAYER :- To enlarge the Petitioner on interim bail in Cr.No.203 of 2022 on the file of the Respondent Police for enable the Petitioner to perform his mother Panchavarnams final rituals pending disposal of the Original Petition.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 02.09.2022, in Crime No.203 of 2022, on the file of therespondent police, for the offence punishable under Section Girl Missing @ Section 366A of I.P.C and Section 6 of POCSO Act, seeks interim bail.

2. On the side of the petitioner, it is stated that his mother is dead. The petitioner being an only son and he has to perform final rites for his late mother and prayed for an interim bail enabling the petitioner to attend the funeral.

3. On the side of the prosecution, it is verified and admitted that the petitioner's mother passed away.

4. In view of the same, this Court is inclined to grant interim bail to the petitioner till 12.09.2022 till 02.30 pm.. Accordingly, the petitioner is ordered to be released on interim bail, on his executing a own bond for a sum of Rs.10,000/-(Rupees Ten Thousand Only) subject to the satisfaction of the concerned Superintendent of Prison.

5. It is made clear that the petitioner shall surrender before the concerned Superintendent of Prison on 12.09.2022 at 02.30 p.m. It is also made clear that the petitioner/accused shall be escorted by the respondent police during the period of transit from the jail and back to the prison at about 02.30 p.m on 12.09.2022. Necessary escort will be provided to accompany the petitioner/accused at the cost of the State.

6. This Petition is allowed.
