PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to take action for evicting the 1/5

encroachment made in T.S.No.9977/1 of Pudukkottai Town, Pudukkottai District by the respondents 5 and 6 within a specified time frame that may be fixed by this Court.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ on hand has been instituted to direct the respondents 1 to 4 to take action for removing the encroachment made in T.S.No.9977/1 of Pudukkottai Town, Pudukkottai District by the respondents 5 and 6 within a specified time frame that may be fixed by this Court.

2.The learned Government Pleader appearing for the respondents 1 to 4 would submit that the revenue authorities conducted survey, identified the encroachments and issued notice to the encroachers under Section 7 of the Tamil Nadu Land Encroachment Act, 1905.

3.The learned counsel appearing for the petitioner would submit that no further action was taken, since the petitioner has filed the present Writ Petition and the encroachments are causing obstructions to the public and therefore, removal is imminent.

4.That being so, enforcement action initiated must be continued and the encroachments are to be removed without causing any undue delay. Therefore, the respondents 1 to 4 are directed to continue the enforcement action already initiated and conclude the same by evicting the encroachers, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 5.With the above direction, this Writ Petition stands disposed of. No costs.
