This criminal miscellaneous petition is filed to dispense with the personal appearance of the petitioner in C.C.No.160 of 2019 before the Judicial Magistrate Court No.II, Sivagangai District till pending disposal of the above quash petition.

2. It is submitted that the petitioner is the second accused and is aged about 75 years. He has been implicated solely on the ground that he is a friend of the first accused. It is further submitted that the first accused died. The first accused was the son-in-law of the Secretary of a private college. The defacto complainant and others are alleged to have paid money for securing employment in the said college. The petitioner has been arrayed as an accused on the allegation that the amount was collected by the first accused along with him. However, according to the petitioner, he has no role whatsoever in the administration of the college. Despite this, he has been added as an accused in the case. It is further submitted that though the final report was filed in the year 2019, there has been no progress in the case, and it still remains at the stage of framing of charges.

3. In view of the above, the personal appearance of the petitioner in C.C.No.160 of 2019 before the Judicial Magistrate Court No.II, Sivagangai District, is dispensed with for the present.
