ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 20(b)(ii)(A), 29(1), 8(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 and section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015 , in Crime No. 57 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that when the police party visited the place of occurrence, the accused persons found in possession of 365 gms. of ganja. Hence, the case.

3.Earlier applications filed by the petitioner was dismissed by this Court on the ground that though the petitioner is a college going student, has not attended the college regularly. Considering the seriousness of the offence also, that petition was dismissed.

4.Now this petition has been filed on the ground that co-accused in this case has been released on bail.

5.The learned Additional Public Prosecutor would submit that there is no change of circumstances.

6.Even though the counsel for the petitioner submitted that the co-accused was arrested and released on bail, that cannot be extended to the this petitioner.
