Mr.R.Suresh Kumar Government Advocate (Crl.side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.Not known of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 506(ii), 323, 324 of IPC, in Crime No.Not known of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that there exists an enmity between the defacto 1/3

complainant's son and the petitioner and on 25.07.2023 when the defacto complainant and his son were in their shop, this petitioner along with others alleged to have tried to assault and kill the defacto complainant's son. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case. He seeks for the relief of anticipatory bail.

4. The learned Additional Public Prosecutor would submit that enquiry is kept pending for want of CCTV footage in the nearby area.

5. Considering the facts and circumstances of this case, the respondent police is directed to complete the enquiry within a period of 15 days from the date of receipt of a copy of this order. The petitioner is directed to appear before the respondent police and co-operate with the investigation. If any trouble arises during the course of enquiry, the petitioner is at liberty to workout remedy through appropriate proceedings.
