ORDER

This Civil Miscellaneous Petition has been filed to restore the Civil Miscellaneous Appeal in C.M.A.(MD).No.378 of 2020 which was dismissed for default on 03.02.2023.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The names of respondent Nos.3 and 5 have been printed in the cause list.

4. The learned counsel for respondent Nos.1, 2, & 4 has raised only formal objections to this petition.

5. The learned counsel for the petitioner submitted that the delay of 151 days in filing the present restoration petition was already condoned by this Court on 31.10.2025 in C.M.P.(MD)No.10698 of 2023 in C.M.A. (MD)No.378 of 2020.

6. Being satisfied with the reasons stated in the affidavit, and also considering the fact that this is only a consequential petition, this Civil Miscellaneous Petition is allowed.
