For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.205/2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of TNSC (RDCS) Order 1982 r/w 7(i)(a)(ii) of EC Act, 1955 in Cr.No.205 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner had illegally transported 400 kgs of PDS rice. Hence, the present complaint.

3.On the side of the petitioner, it is stated that the petitioner is innocent and he has been falsely implicated in this case and prayed the petitioner to be released on anticipatory bail. https://www.mhc.tn.gov.in/judis 1/2

No.16357 of 2022 4.On the side of the prosecution, it is stated that the petitioner is said to have illegally transported 400 kgs of PDS rice and the entire contraband was seized by the respondent police. It is fairly admitted that the petitioner is having five previous cases, which are similar in nature and prayed the petition to be dismissed.

5.Considering the seriousness and gravity of the offence alleged against the petitioner and on considering the fact that the petitioner is having five previous cases for similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 14/09/2022 / TRUE COPY / /09/2022 Sub-Assistant Registrar (C.S.)
