ORDER
This Writ Petition has been filed in the nature of Mandamus seeking a direction against the first respondent/the Regional Passport Officer, Tiruchirappalli to remove the block in respect of the passport of the petitioner bearing Passport No.R1933342. The petitioner had given a representation on 09.10.2021.
2. Heard Mr.P.Deepan Chakravarthi, learned counsel for the petitioner, Mr.Sivakumar, learned Standing Counsel for the first respondent and Mr.S.Shanmugavel, learned Additional Government Pleader for the second and third respondents. 1/3
3. The respondents have no objection to grant such relief to the petitioner herein. It is claimed that the petitioner was only a witness in a criminal case and not an accused. This is the stand of the third respondent. He was a witness during the trial which took place pursuant to investigation in Crime No.1 of 2017 in which the accused was Yasin Melines and that particular criminal case after trial, had also ended in acquittal. There is no reason for the petitioner's passport to be still kept in the category of block. The said category and the said remark will have to be necessarily removed.
4. Let me not enter further into the details of the criminal case which had actually ended in acquittal. Let me give a direction to the first respondent to remove the remark/block so far as the passport of the petitioner is concerned within a period of ten (10) working days from the date of receipt of a copy of this order.
5. With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
