Respondent PRAYER: Writ Petition under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the order dated 14.10.2014 made in RC.A4/5935/2014 by the respondent and quash the same and consequently direct the respondent to forthwith disburse the petitioner's service benefits such as death cum retirement gratuity (DCRG) and encashment of leave benefits with interest. ORDER

The relief sought for in the present writ petition is to quash the order dated 14.10.2014 declining to grant terminal and pensionary benefits to the petitioner.

2.The petitioner was working as Village Administrative Officer and he reached the age of superannuation on 30.11.2013 and not allowed to retire from service, on account of the pendency of the disciplinary proceedings and the criminal case. 3.Now, it is brought to the notice of this Court that the criminal case is ended with an order of conviction. Pursuant to the order of conviction, the petitioner was dismissed from service. 4.The learned counsel appearing for the petitioner states that even the dismissed employee is entitled to get the monetary benefits, which is applicable in accordance with the rules based on his contribution.

5.Thus, this Court is of the considered opinion that whatever the benefits for which the petitioner eligible is to be settled in https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD).No.19156 of 2014 accordance with the rules in force. In this regard, the respondent is directed to verify the service records of the writ petitioner and settled the dues, as per the rules in force as applicable to the dismissed employees, within a period of twelve(12) weeks from the date of receipt of a copy of this order. The writ petitioner is also permitted to produce the documents and representation to the respondent mean while.

6.With the above direction, this Writ Petition stands disposed of. No costs.
