O R D E R
This writ petition is filed for a writ of mandamus directing the first respondent to consider the representation of the petitioner dated 14.11.2014 and for taking appropriate action as against the fourth respondent, by fixing certain damages for the harassment made by the fourth respondent.
2. This writ petition has been filed in the year 2014 and when 1/3
the matter was listed on 30.04.2021 and on 06.07.2021, there was no representation for the petitioner. Even today, there is no representation on behalf of the petitioner.
3. Perusal of record shows that the petitioner sent a representation on 14.11.2014 that the fourth respondent / Inspector of Police, Sivagangai Town Police Station is harassing the petitioner and his family members under the guise of enquiry and therefore, he moved this petition.
4. Mr.S.Ravi, learned Standing Counsel for the State submitted that there was an incident took place near the petitioner's residence on 19.10.2013, wherein, one Vijayal, W/o.Balasubramaniam was subjected to murder for gain. The investigation was conducted by the fourth respondent and in the course of the investigation, the fourth respondent called the petitioner and other residents of that locality for collecting the materials to find out the truth in the case. Since the petitioner has been called for enquiry, he has approached this Court by way of this writ petition in the year 2014.
5. Learned Standing Counsel further submitted that the investigation revealed that the husband of Vijayal, namely, Balasubramaniam is the accused in that case and therefore, the case was proceeded as against the said Balasubramaniam in Crime No.844 of 2013. The final report was also filed in the year 2018, but, pending the trial, the accused Balasubramaniam died and therefore, the charge was also abated.
6. In view of the aforesaid submission made by the learned Standing Counsel for the State, this writ petition stands closed as no further order is required to be passed. No costs.
