[Order of the Court was made by G.ARUL MURUGAN, J.] The writ petition has been filed seeking a direction to the respondents 1 to 5 to remove the encroachments made in the grazing land in survey No.133 situated at Naatanipurasakudi Revenue Village, Avudaiyarkoil Taluk, Pudukkottai District, by the private respondents 6 to 26.
2.Heard the parties.
3.The learned Special Government Pleader on instructions would submit that the Tahsildar would take appropriate proceedings in identifying the encroachments and on identification, necessary steps will be initiated under the Tamil Nadu Land Encroachment Act and the encroachments identified would be removed.
4.The learned Counsel appearing for the private respondents would submit that the private respondents are ready to remove the encroachments voluntarily, on identification of encroachments. 4/7
5.In view of the this submissions made, the Tahsildar/third respondent is directed to take appropriate proceedings under the Tamil Nadu Land Encroachment Act by affording opportunities to the private respondents who are in encroachment, within a period of twelve weeks from the date of receipt of a copy of this order. 6.With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
