ORDER

This Criminal Original Petition had been filed to direct the learned Judicial Magistrate, Padamanabhapuram, in C.C No.123 of 2015 to dispose the case within stipulated time by this Court. 1/4

2.When the matter came up for hearing, there is no representation on behalf of the Petitioner.

3.The learned Additional Public Prosecutor appearing for the Respondent submitted that the case is of the year 2015 but till date summon could not be served to A3 and summon already served to A1. A1 had approached this Court seeking early disposal of the case.

4. In the light of the above submission, the learned Judicial Magistrate, Padamanabhapuram, is directed to split up the case against the absconding accused and proceed with the case regarding the Accused who are in attendance before the learned Judicial Magistrate, Padamanabhapuram. Further, the learned Judicial Magistrate, Padamanabhapuram, is directed that the trial shall be conducted on the day to day basis and examining of independent witnesses can be completed within three days and the official witnesses can be examined in another three days. So that the examination of witnesses shall be completed within a reasonable period of fifteen (15) days. Further, the learned Judicial Magistrate, Padamanabhapuram, shall dispose of the case within a reasonable period of three months.

5. With the above directions, this Criminal Original Petition is disposed of.
