PRAYER :- For Bail in Crime No.514 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.1 herein, who was arrested on 22.07.2023 for the alleged offence under Sections 4(1)(a) r/w.4(1-A) of Tamil Nadu Prohibition Act, in 1/4
Crime No.514 of 2023, on the file of the respondent police, seeks bail.
2. The prosecution case is that the accused persons were found in illegal possession of 12 numbers of brandy liquor bottles (180 ml) and the same was recovered by the respondent Police. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Two days before the occurrence, there was a quarrel between the defacto complainant and the petitioner. Due to which, he has filed the false case against the petitioner.
4.The learned Additional Public Prosecutor submitted that there is no previous case pending against the petitioner.
5.Considering the facts and circumstances of this case and considering the duration of custody and the petitioner is not having any previous cases, this Court is inclined to grant bail to the petitioner with certain conditions; 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the 2/4
