[Order of the Court was made by The Hon'ble The CHIEF JUSTICE] Heard the learned counsel for the petitioner, learned Additional Government Pleader for the respondents 1 and 2 and the learned Senior Counsel for the respondent No.4.
2.The learned counsel for the petitioner submits that the respondent No.4 is not allowing the petitioner and the other persons to use the connection road starting from Dindigul to Batlagundu Main Road reaching to Adi Dravidar Colony, Chinnapallappatti. Hindrance is caused by the respondent No.4.
3. According to the learned Senior Advocate for the respondent No.4, lay-out is sanctioned. In the lay-out, existence of a road is already shown. The petitioner and other persons do not want to use the said road 2/5
and are trying to create the road from the land of the respondent No.4.
4. It would be a disputed question as to the exact location of the road. The concerned Panchayat Union may consider the grievance that may be putforth by the petitioner. The petitioner may give representation to the concerned Panchayat Union. The concerned Panchayat Union, after considering the stand putforth by the respondent No.4, shall decide the said representation of the petitioner, preferably, within six months from the date of the representation made.
5. The Writ Petition accordingly stands disposed of. However, there shall be no order as to costs. Consequently connected Miscellaneous Petition is closed.
