Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the respondent vide Letter No.14363/Admin/2021-1 dated 16.08.2021 and quash the same as illegal and may direct the respondent to renew the period of Notary of petitioner for a further period of 5 years from 29.01.2022.

ORDER

The petitioner is an Advocate. He enrolled his name as an Advocate on 12.09.1990 and he has been practicing continuously. Thereafter, he had recognised as a Notary Advocate and the Government Order to that effect was issued in the year 2002. The Notary period expired during the period of Pandemic and the petitioner has not sent any application for renewal of the Notary. Thereafter, the petitioner submitted an application on 19.07.2021 and the said application was rejected on the ground that the said application was not sent within the period.

2. The Hon'ble Supreme Court and our High Court has extended the period, which had expired during the Pandemic period, and an exemption has also been granted for the delayed period. But the respondent without considering the same, rejected the application of the petitioner and that has to be interfered with by this Court.

3. The petitioner's application, which was already on the Desk of the respondent, may be reconsidered afresh and necessary orders be passed on or before 31.12.2021. The delay in passing the order will not be a break in the period, for which, the petitioner has been functioning as a Notary.

4. In view of the above, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
