PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to stop of the unpermitted festival function dated 07.08.2023 to 09.08.2023 Sri Uchinikaliyambal and Sri Pattaraiambal which is locating at Udankudi Village, Thiruchenthur Taluk, Tuticorin District based the petitioners representation dated 03.08.2023 and further directing the respondents to permit the petitioner and the petitioner family members and other their village poor families to worship the said temple peaceful. O R D E R
This Writ Petition is filed by the petitioner seeking two reliefs.
2. At the first place, the petitioner wanted the rival group not to conduct temple festival on 07.08.2023 to 09.08.2023 in Sri Uchinikaliyambal and Sri Pattaraiambal Temple situated at Udankudi Village, Thiruchenthur Taluk, Tuticorin District and the second relief 2/6
sought for by the petitioner is that the rival groups are not permitting the petitioner to enter into the temple, thereby, the Police shall be suitably directed.
3. The learned Government Advocate (criminal side) appearing for the official respondents submits that subsequent to receiving of the representation from the petitioner, permission which was given to the rival groups for conducting temple festival from 07.08.2023 to 09.08.2023 has been withdrawn and that the permission was given for conducting of laughing debate and in respect of other allegations made by the petitioner, it is submitted that the petitioner and his family members are allowed into the temple and has been worshipping and nobody has prevented them.
4. In view of the above, this Writ Petition is disposed of directing the petitioners to approach the respondents, in case the rival groups prevent them from worshipping in the temple and in case any such representation is received, the respondents Police are directed immediately to see that the petitioner and his family members are 3/6
permitted to worship in the temple and offer prayers in the temple. There shall be no order as to costs. Connected miscellaneous petition is closed. 08.08.2023 NCC :
