PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to take up the appeal petition preferred by the petitioner on 15.12.2023 and dispose of the same within the stipulated time as fixed by this Court .

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Writ Petition has been instituted, seeking disposal of the appeal petition preferred by the petitioner on 15.12.2023 and the reminders sent subsequently.

2.The learned counsel appearing for the petitioner would submit that No Objection Certificate (NOC) was granted by the 1st respondent in favour of the 2nd respondent to run an industry. However, the 2nd respondent is violating pollution norms, which is causing health hazard in that locality. In this regard, the petitioner has submitted a petition not to grant NOC, which was not considered by the competent authorities and license was granted on 26.07.2023. Since the license was granted in violation of the pollution norms, the petitioner has preferred an appeal before the 1st respondent on 15.12.2023 and sent several reminders. However, no action has been taken, which resulted in filing of the present Writ Petition.

3.In view of the fact that the appeal filed by the petitioner is pending for long time, the 1st respondent is directed to take up the appeal for adjudication, conduct enquiry by affording opportunity to all the parties and thereafter, dispose of the same on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. 4.With the above direction, this Writ Petition stands disposed of. No costs.
