PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the first respondent to conduct enquiry against the misappropriation made by the respondents 4 and 5 and take appropriate action in accordance with the Tamil Nadu Cooperative Societies Act, 1983, within the time stipulated by this Court.

O R D E R

[Order of the Court was made by The Hon'ble ACTING CHIEF JUSTICE] Prayer in this writ petition is to direct the first respondent to conduct enquiry against the misappropriation made by the respondents 4 and 5 and take appropriate action against them in accordance with the Tamil Nadu Cooperative Societies Act, 1983, within the time stipulated by this Court.

2. According to the petitioner, he is one of the members of MD.Thani 88 Saptur Primary Agricultural Co-operative Credit Society. The fourth respondent is the Ex-President and the fifth respondent is the Secretary of the said Society. They have involved in several misappropriations in the said Society during 2012-2018. Though the petitioner has made representations, dated 09.11.2018 and 14.11.2018, to the first respondent, the same have not been considered sofar. Hence, this writ petition.

3. Today, when the matter is taken up for hearing, learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the respondents 1 and 2 to consider the petitioner's representations dated 09.11.2018 and 14.11.2018, on merits and in accordance with law.

4. In view of the above submission, we direct the respondents 1 and 2 to consider the petitioner's representations, dated 09.11.2018 and 14.11.2018, pass orders on merits and in accordance with law, after providing due opportunity to the parties concerned, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
