ORDER
The writ petition is filed seeking a direction to the respondents to issue a Joint Patta in the name of the petitioners in respect of the land in S.No.32/5 admeasuring to an extent of 2.52.50 hectares in Vacchakarapatti Village, Virudhunagar Taluk and District, after change of classification of the land from Government Poramboke - Odai in the light of the recommendations made by the Village Administrative Officer, Vachhakarapatti Village dated 08/11/2022 and 08/05/2025; Virudhunagar Revenue Inspector in November 2023; Zonal Deputy Tahsildar, Vachhakarapatti on 30/11/2023; Tahsildar, Virudhunagar in proceedings dated 27/12/2022; within a reasonable period to be determined. .
2. Heard the learned counsel appearing for the petitioners and Mr.A.Baskaran, learned Additional Government Pleader who takes notice for the respondents 1 to 5.
3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself. 3/8

It is the case of the petitioners that the subject land was assigned in favour of the petitioners father Madasamy by the proceedings of the Assistant Commissioner of Land Reforms, Tirunelveli dated 17.08.1992. A portion of the said property was gifted by the said Madasamy in favour of the petitioners mother in the year 2011. Thereafter, a joint Patta was issued in the name of the Madasamy and Analakshmi in Patta No.810.
5. The petitioners father and mother died on 24.05.2019 and 22.08.2019 respectively. Thus, the petitioners are entitled to the subject property. When the petitioners verified the revenue records in the year 2022, it came to their knowledge that the subject lands had been wrongly classified as Government Poramboke - Odai. Hence, the petitioner submitted series of representation before the respondents seeking reclassification of the same and issuance of patta in the name of the petitioner.

The Village Administrative Officer of Vachhakarapatti Village, Revenue Inspector and the Tahsildar of Virudhunagar District have submitted a report in favour of re-classification of land and issuance of joint Patta in the name of the petitioners. Inspite of the same, the request made by the petitioners has not been considered by the competent authority. Hence, the petitioners submitted a detailed representation on 06.09.2022 before the respondents, seeking issuance of Joint Patta after re-classification of land. The same has not been considered. Hence, the petitioner has come before this Court.

In view of the same, without expressing any opinion on the merits of the matter, the 2nd respondent is directed to consider the representation of the petitioners dated 06.09.2022 and pass final orders on its own merits in the light of the report submitted by the Tahsildar, Virudhunagar in e/f/M2/6084/2022 dated 27.12.2022 within a period of twelve (12) weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioners and other interested parties. 5/8
8. The writ petition is disposed of with the above observations. No costs.
