RESPONDENT/PETITIONER Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 465 days in filing the above Writ Appeal and this render justice.

To allow the Writ Appeal by setting aside the order passed in W.P.(MD)No.21327 Of 2016 and thus render justice. Prayer in WP(MD). 21327/ 2016 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of 1/3

Mandamus directing the 2 and 4 respondents to regularise the service of the petitioner fro the date of his initial appointment as per G.O.Ms.No.996, P and A reforms (placements) department, dt.22.09.1984 and to give notional promotion to the petitioner and to pay the monetary benefits retrospectively. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.M.MUTHUGETHAIYAN, Special Government Pleader for the petitioners and of the Respondent not appeared either in person or by an Advocate, the court made the following order:- [Order of the Court was made by M.SATHYANARAYANAN, J.,] This Court heard the submissions of Mr.M.Muthugeethaiyan, learned Special Government Pleader appearing for the petitioners.

2. Though notice has been served and his name appears in the cause-list, there is no representation on behalf of the respondent.

3. This Court has perused Paragraph No.9 of the affidavit filed in support of this petition and the delay appears to be administrative in nature and hence, the delay in filing the above writ appal can be condoned by putting the petitioners on terms.

4. In the result, this civil miscellaneous petition is ordered subject to the condition that the petitioners shall jointly pay a sum of Rs.5,000/- (Rupees Five Thousand only) to Additional Registrar General in-charge/Registrar Judicial, for the improvement of the amenities relating to virtual Court proceedings etc., within a period of two weeks from today and the learned Special Government Pleader appearing for the petitioners also undertakes to file a memo through e-mail to the Registry. The Registry on receipt of the said memo, shall number the writ appeal, if the papers are otherwise in order and list it for admission.
